Food Allergies Cause Personal Injury Suit Against McDonald's

A food allergy can be a difficult and tiresome battle to deal with. Parents with children of food allergies, especially more-encompassing allergies such as gluten, know the caution needed to be taken each time their child is given something new to eat. Frank and Beth Miller are parents of not one, but two children with food allergies. Their oldest son, Mekenzie (7-years old), has celiac disease, making him allergic to gluten and wheat. Their 4-year old, Macauley, is autistic. Milk, gluten, and wheat worsen his behavior problems.

The Millers went to McDonald’s one day and after thoroughly inspecting the ingredients, allowed their sons to have French fries. Later that day, the boys experienced emotional distress and physical illness. It turned out that the French fries included both casein and wheat, even though they were not listed on the ingredients section. There is now a Personal Injury suit being brought against McDonald’s for the two boys. Along with this case, there are 16 Personal Injury cases in Florida and one federal class action suit against McDonald’s.

Any company or organization dealing with the sale or production of food products have the responsibility to provide food that will not cause illness or death. Children's Hospital in Sacramento Provides Pet Therapy to the Severely Injured

In our own home town of Sacramento, pets are being used to heal sick children. Yes, you heard me right. At Shriners Hospital for Children - Northern California, volunteers bring in pets for the children to play with or just be around. The children seem to greatly benefit from the pets. Take for example, Rachael Wilson, a patient who suffered a spinal cord injury at age 12, who says she feels like the pets give her a sense of freedom she did not have before. Another patient, 15-year old Austin Lee, has been in a wheelchair since he was hit by a truck some time back. He says that he loves having the pets visit and that they remind him of his own pets back home.

The hospital serves as a place children go after severe accidents as well as a place for ongoing treatments and surgeries. The animals take some of the tension out the ordeals the children are subject to go through.

Other studies show that pet therapy does in fact, seem to aid those who face a terminal or life-altering illness. These animals can offer a constant source of comfort, a feeling of unconditional love, and an attentional focus. For example, one study was conducted on patients who were in the intensive care unit for heart attack or angina. One year after the hospitalization, 28% of patients who did not have a pet died, compared to 6% of deaths in patients who did own a pet.

Although I wouldn’t start saying that pet therapy is a total cure for sickness, it does seem to have many benefits. If you or a loved one is suffering from a life-altering or life-threatening illness, I would say to give it a try. The comfort and joy you can find in a pet can be incredible.

Attack in Spin Class Causes Back Injury

I read an interesting story today in the news. A spin class at a posh health club ended with an assault and serious back injury. Apparently, a Wall Street stock broker, Christopher Carter, snapped during the cycling class and attacked another cyclist, Stuart Sugarman.

According to the allegations, Stuart, continued letting out hoots and grunts during the exercise even after Christopher asked him to stop. The Wall Street broker eventually snapped, picking up both Stuart and his bike and throwing them against the wall (seems like the class is working for him). Stuart ended up in the hospital, suffering from a herniated disc and requiring surgery.

Although this situation seems a bit humorous, there are serious consequences that come from someone acting out in anger at another person. It may not always be “spin rage”, as Stuart’s lawyer is calling Christopher’s actions, but it may be a rage that puts someone else’s life at risk.

Wrongful Death - A Sacramento Lawyer Explains

Dangerous! Sacramento Bee Finds Many College-Aged Students Not Insured

Accidents happen to people of all ages. Adults take brutal slip and falls, teens suffer from devastating spinal cord injuries, young adults get into severe car accidents. No matter what your age, you should always have insurance to protect you in these situations. Even if it is someone else’s fault, they may not have insurance or enough insurance to cover your injuries. You should make sure you are protected.

I was reading an article in the Sacramento Bee today that spoke of the lack of insurance in college-aged students. At my Law Office, I am constantly around injuries and accidents. I know how devastating it can be to be injured by someone else’s negligence or misconduct, and then not be able to receive compensation because they and you do not have adequate insurance.

The Sacramento Bee article stated that one-third of 18 to 24-year olds have no health insurance. This is a big threat in the case that these young adults get badly injured. We all know that teens and even college-aged kids think that they are invincible, but it is often this age that people suffer the most life-altering injuries, such as spinal cord injuries.

For health insurance, most family health care plans will cover a dependent child while they are in school or up to 23-years old. Many colleges also carry their own health clinics and health insurance policies that are usually significantly cheaper than normal health insurance policies. Our nearest UC college, UC Davis, made health insurance mandatory for all of its students after a study revealed that almost 40% of students were uninsured or underinsured.

As for auto insurance, it is illegal to drive without it. If you are pulled over or in an accident without auto insurance, chances are that your license will be taken away. Find yourself in a serious auto accident without insurance and you could be facing much more serious consequences than a revoked license; you could end up with thousands of dollars worth of hospital bills that you are unable to pay. Again, there are insurance policies for college students and low income earners that are much more affordable than the average auto insurance policy. Insure yourself, and make sure to include uninsured/underinsured coverage.

Heart Attacks A Common Medical Malpractice

Heart disease is the number one killer of Americans today. In the United States, one-fourth of all Americans have heart disease, accounting for about 64 million people. Assault on Employee Brings Case Against Wendy's

I read an article in the news today about a Wendy’s employee suing the company in a personal injury suit. As a Personal Injury Attorney in Sacramento, I think it is always interesting to learn about cases going on throughout the United States, especially if they are not your typical story.

The article states that the woman, Janet Brandon, was attacked and injured in the Wendy’s parking lot as she tried to take the morning deposit to the bank. Janet was an assistant manager and it was her responsibility to take the morning deposit to the bank. Unfortunately for her, Wendy’s had apparently not created any secure guidelines in how to do so. To protect herself, Janet placed the money in a Wendy’s sack to disguise it and planned to give the bag to a co-worker who, in turn, would pass it to her as she came to the drive-thru window.

As she left to get in her car, however, Janet was hit in the head and knocked unconscious. She lay there for 30 minutes, until workers at the Exxon next door saw her on the ground.

Janet was taken to the hospital and diagnosed with brain damage and a closed head injury.

Janet is suing Wendy’s for not implementing adequate procedures and policies for their employees when making deposits. This, she claims, leaves the employees without safety or security.

I am interested in how this will turn out. Wendy’s has already responded as denying all allegations and says they are not at fault for 3rd party actions (the men that attacked Janet). There are several more key factors that will need to be discovered, including whether there is a direct correlation between the attack and the deposit.
